Introduction

These Terms of Service ("Terms") govern your access to and use of GPT-IMG (the "Service"), available at gpt-img.com, including our website, AI image generation tools, prompt gallery, and related features. By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

In these Terms, "we", "us", and "our" refer to the operator of GPT-IMG, and "you" refers to the person or entity using the Service.

Eligibility

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority in your jurisdiction) to make purchases. By using the Service, you represent that you meet these requirements and that you are legally able to enter into these Terms.

The Service

GPT-IMG is an AI image platform that lets you generate and edit images from text prompts and reference images using third-party AI models, including OpenAI's GPT Image and Google's Gemini ("Nano Banana") models. Models are accessed through upstream providers such as fal.ai and APImart. Available models, capabilities, resolutions, and credit pricing are described on our Models page and may change over time.

The Service is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, secure, error-free, or that any specific model or feature will remain available.

Accounts

To use most features you must create an account using email and password or by signing in with Google. You agree to provide accurate, current, and complete information, to keep your credentials secure, and to be responsible for all activity that occurs under your account. Notify us promptly at support@gpt-img.com if you suspect unauthorized use. One person or entity may not maintain multiple accounts to abuse free credits or promotions.

Credits, Subscriptions, and Payments

The Service operates on a credit system. Each image generation consumes credits based on the selected model, resolution, and quality, as shown on the Models page.

• Free credits: New accounts may receive a limited number of complimentary credits. These have no cash value and may be modified or discontinued at any time.
• Subscriptions: Paid plans grant a recurring credit allowance and renew automatically at the then-current price until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Pricing: Prices are shown in U.S. dollars and may exclude applicable taxes. We may change pricing, plans, or credit costs prospectively; changes will not affect a billing period you have already paid for.
• Payment processing: Payments are handled by third-party processors (Stripe or Creem). We do not store full payment card details. Your use of payment services is also subject to the processor's terms and privacy policy.
• Refunds: Except where required by law, payments and consumed credits are non-refundable. Credits are a license to use the Service, have no monetary value, are non-transferable, and may expire as described on your plan.

Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

• Violates any applicable law, regulation, or third-party right;
• Depicts child sexual abuse material (CSAM) or sexualizes minors in any way;
• Constitutes non-consensual intimate imagery, or realistic depictions of real, identifiable people created to deceive, harass, defame, or impersonate them;
• Promotes hatred, harassment, violence, self-harm, or discrimination against individuals or groups;
• Infringes copyrights, trademarks, publicity rights, or other intellectual property;
• Contains malware, or attempts to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or its providers;
• Bypasses usage limits, credit costs, content filters, or rate limits.

You are also bound by the content and usage policies of the underlying model providers (including OpenAI and Google). We may filter, refuse, suspend, or remove generations and accounts that violate these Terms or those policies, with or without notice.

Your Content and Generated Images

You retain ownership of the prompts and reference images you submit ("Input"). You represent that you have all rights necessary to submit your Input and that it does not violate these Terms or any third-party right.

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Input and the resulting generated images ("Output") for the purposes of providing, securing, and improving the Service, including sending your Input to the AI providers described above.

Subject to your compliance with these Terms and the applicable model provider's terms, you own the Output you generate to the extent permitted by law. Because of how generative AI works, Output may not be unique, may resemble content generated for other users, and may not be eligible for certain intellectual-property protection. You are solely responsible for how you use the Output, including ensuring it is lawful in your jurisdiction and intended use.

Intellectual Property

The Service, including its software, design, branding, text, and the "GPT-IMG" name and logo, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or proprietary materials except as necessary to use the Service.

Third-Party Services

The Service relies on third parties, including AI model providers (fal.ai, APImart, OpenAI, Google), payment processors (Stripe, Creem), and infrastructure providers (Cloudflare). We are not responsible for third-party services, and your use of them may be governed by their own terms.

Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service and all Output are provided without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or applicable law.

Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties. You may stop using the Service at any time. Upon termination, your right to use the Service ends, and unused credits are forfeited except where prohibited by law.

Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on this page and updating the date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
